Bailing Out Those Who Can't Make Bail

Portugal has gone perhaps the farthest in decriminalizing drug use. It hasn't stopped drug usage, but it has reduced deaths, the spread of H.I.V., drug crime, and imprisonment.

Research has shown that criminal activity is often a result of a person with a mental illness falling into substance abuse and jail time does nothing to help a person’s illness. To lower the number of people with a mental illness in the criminal justice system, the Mercer County Prosecutor’s Office have been practicing an “informal Mental Health Court,” where defendants are put in a life coaching program instead of jail.

In India, failing road safety and accident respondent systems have created a nationwide crisis. SaveLife Foundation is addressing these problems head on, through outreach, legal battles, and innovative solutions to ineffective government policy.

When the federal government fails to stimulate social change, local areas step up. Tennessee is giving more structure and funding to community college education, and it’s drastically increasing graduation rates. Alaska and other states are getting rid of money bail. All around the country, citizen activists are becoming advocates and attempting to make our political system accessible to everyone. Despite partisan politics in Washington, D.C., the country is nonetheless experiencing social progress.

A new restorative justice court in a Chicago neighborhood shows promise in bringing healing to the community through having defendants repair harm they’ve done and reintegrate into the community. It has support from key members of the criminal justice system but it faces funding issues and getting buyin from the community. Some argue restorative justice cannot operate effectively within the existing criminal justice system.

Street Outreach Court Detroit is a collaboration between the courts and service providers to waive legal and financial obligations post-conviction if a person makes a commitment to an individualized action plan. These plans can include steps such as substance misuse treatment, enrolling in a workforce readiness program, and accessing housing subsidies.

In 2017, New Jersey eliminated the cash bail system – meaning that potential offenders awaiting court could not be held in jail for money. Instead, judges use an algorithm that considers the individual’s criminal history, flight risk, and threat level to the community. As New York considers doing the same, it looks the impact it has made in New Jersey.

Merging accountability with treatment promotes recovery for those charged with drug possession. In Franklin County, Ohio, the municipal court system operates a program called Helping Achieve Recovery Together. The court recovery program provides a two-year track for participants to receive mental health support from peers and the courts, with the goal of moving them from the criminal justice system and into treatment.

Leading up to Father’s Day, Philadelphia criminal justice organization Frontline Dads raised money to bail out fathers. Inspired by the annual Mother’s Day bailouts that happen around the country, Frontline Dad aims to not just free father’s, but raise awareness about the issue of cash bail as well. Beyond bailing out fathers, participants will also have access to services like haircuts, counseling, and job placement assistance.

In his first months as the New Orleans district attorney, Jason Williams has pushed a prosecution-reform agenda that not only limits who gets sent to prison on the front end, but also takes a backward look at who should be let out of prison. Nearly two dozen people convicted by non-unanimous juries have been granted new trials. Some people have been granted early release from prison after conviction under unduly harsh sentencing laws that no longer will be enforced. Williams' ultimate goal is to restore community trust so that necessary prosecutions have community support.
